  • @miginaustria You don't understand his position at all if you think either of those cases shows him to be a hypocrite--especially with respect to Lawrence, where he took no position at all on the morality of the legislation under consideration. Rather, his position was that the Constitution did not speak to that law one way or another, and that it is not his job to be an arbiter of good and bad laws. Like most people, you simply don't grasp the substance of his point.

  • I think he has a diminished the sense of justice, and the humanitarian sense of prudence. In fact he has a totalitarian sense of Justice. He says judges do what the people say we should do.

    This argument took the Edge may lead to totalitarian government. The other argument against it is the literal interpretation of the Constitution. The framers were not gods. They were intelligent men, wise, but they were not omniscient. That means they could not foresee all the confrontations that would come.

  • @miginaustria, speaking of the lawrence case, he supports democracy, the legislators already outlawed homosexual sodomy, he's just adopting what the ppl wanted, they already legislated it.

  • Scalia protests that he is an originalist and doesn't want to go beyond the original intent of the constitution, and that he doesn't want to be an arbiter of morality.

    His decisions show that is BS.

    He voted to confer civic personhood on corporations (how can he justify that with basis on the constitution??), which will ruin american democracy with more special interest money. In his position on the Lawrence case you will see he has no problem being an "arbiter of morality".
