Walkhom from the Toronto star asked a great question. I dont understand it either.
Why is Khalid Mohammed, the self proclaimed mastermind of the 9/11 terror attacks, gets a fair trival with all the constitutional protections, while Omar Khadr, the Canadian child soldiers accused of killing an American sergeant during battle, will still be tried before a military tribunal, also referred by military lawyers as a kangaroo court.
The former military commission wrote that these military tribunals are set up to secure a conviction which would otherwise be impossible if they were given an actual fair trials.
These military tribunals were deemed unconstitutional by the U.S supreme court back in 2006, President Obama has passed amendments to ensure that information gained from torture will not be used.
Lets get this fact straight one more time, Omar Khadr is child soldier detained at Gitmo since he was 15.
Does a military tribunal has the right to judge a juvenile? Especially one who has been detained and tortured for 7 seven years and counting , still hasnt been able to secure a fair trial, how can we expect a fair trial now after all these years? If they had evidence, he would have been convicted long ago.
According to the Human Rights watch, no international tribunal since Nuremberge has prosecuted a child for alleged war crimes. The United Nations committee that monitors the rights of children found that the United states has held alleged child soldiers at Guantanamo without due account of their status as children and concluded that the conduct of criminal proceedings against children within the military justice system should be avoided.
He was accused of throwing a grenade that killed an Army medic in Afghanistan, but that particular charge has been questioned because while the government originally accused Khadr as the only person who could have threw the grenade that killed the U.S medic, documents shown that the only witness that saw Khadr describe actually finding two people alive in the compound, and the first man was shot and killed before Khadr was found and captured.
The Omar case is a disgrace not only for the Obama administration but particularly for the Canadian government, which has insist on refusing to accept the findings of the two lower court decisions that found Khadrs right under Charter of Rights and freedom had been breached. Lets hope that the Supreme Court of Canada will finally do what the Harper government has neglected to do, to treat all Canadians with equal constitutional rights and protection.
How can Canadian blames the Obama administration for mistreating our own citizen when our own government refuses to denounce the abuse and torture and commit to fair trial for all?

This is bullshit, our own Canadian Forces allows recruiting into the reserves at the age of 16 (I should know, that's how old I was).
What the Geneva convention on Child Soldiers actually states is children younger than 15 are protected, if Omar had thrown the grenade when he was a year younger you're right he would get off free, thank god he wasn't.

Mr. Harper will wait and see what the outcome of the court. The other parties can pass laws together forcing Mr. Harper to do something here. America is a free country and I am confident that the truth will come out in the courts although I share your view that it should be a civilian courts.

Another ignorant comment. Every other developed country has seek extradition or repatriation of their own citizens in Guantanamo bay. The only Western citizen remaining in Guantanamo, Khadr is unique in that Canada has refused to seek extradition or repatriation despite the urgings of Amnesty International, UNICEF, the Canadian Bar Association and other prominent organisations.

And the British, Australian and French supreme courts all took the oppsite postion, the same position as the vast majority of Canadian citizens by the way.
Just because a couple ultra left judges thinks we should repatriot him doesn't make it right.
