Name Withheld: "The Constitution allows me to talk to somebody...

Cop (sarcastically): "Sure..."

Actually the street is city property, not school property. For the cop to imply she can't talk to the trees, and to insist that she cannot be seen at that part of Peidmont during the duration of the Tree Sit, is against police operational procedure and is an illegal demand of the police. The officer may as well attempt to ban the visitor from entire city of Berkeley; he has the same amount of authority to do so - ie: none.

The visitor, someone with disability, had never been by the protest site before.

Note the cop says that the guards have cameras rolling most of the time, and says that the guard claims to have seen the visitor to the trees in a previous incident. Yet the cop never claims that the visitor to the trees was actually caught on tape breaking the court order. And the cop never claims that any officer saw the visitor on tape. It's an important distinction.

What happens with the school offers cash and job security incentives to guards? The guards often just decide to point at anyone, to help make their quota.

  • @Sublimecriminal just because he asks does not mean she has to do it. she has a right privacy.

  • I hate cops, but I hate hippys WAYYYYYY more.

    Lazy sacks of shit....

  • the guy on camera needs to shut the hell up and let the cop do his thing, he's asking for a photo ID, not a DNA sample, this is why there are so many problems with protest, people like the camera guy take it to the extreme and make it difficult for everyone.

  • Actually, A police officer can give her a legal order to disperse and failure to comply is illegal.

  • Wow, this is what UC Berkeley PD have to deal with... I would never want to work there. Mad respect for UCPD over there.

  • Dn't make fun of others who have a disability. It makes you look like the ass.

  • You tree huggers are so stupid. So he is supposed to remember her red hair? Who was that guy talking about something he is not involved with. It sounds like Nathan Pitts. I know that guy and he is an idiot. His main excuse for acting stupid is that he has ASSbergers disorder. You all just sit up and hate the police until you need them to mop you up off the ground when you get robbed. When that happens you will not get help from your fellow tree people.

  • Fucking Nazi fascists. They cannot tell her to leave and threaten her that if she comes back she will be arrested/sited like that. Sited for what? Not having her papers? Not having her religious officiation sewn onto her shirt? How about a big Star of David on her arm? Is that what you want to see fucking Nazi!

  • again cops coping names for the database..
