Professor Frederick Schauer examined whether thinking like a lawyer is unique to the legal profession at an alumni luncheon on April 30. Schauer is a David and Mary Harrison Distinguished Professor of Law at the University of Virginia School of Law.
This is "thinking like a legislator", not "thinking like a lawyer." Thinking like a lawyer is particularist. It involves arguing for your client even when that means rejecting precedent or rules. Thinking like a lawyer does not mean tolerating the wrong answer; it means arguing that your client's position is right.
