It's a Common Law right, not a Statute one, if they were being charged with a Common Law violation then it might work, but they are not. And Common Law is still being used today.
@RetSquid Common law has been incorporated into statutory law a long time ago and the right of trial has been preserved it is part of due process. If you think that a statute can take that right away then there is no right at all.
The Seventh Amendment says, "In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved.."
This is not a Common Law dispute, it's Statutory law.
