Asset Forfeiture (Part 1 - Dr. Margaret Beare)

In 2001, Ontario's Progressive Conservative government introduced legislation to allow the Crown to confiscate property that might one day be used in a crime, or that might have been purchased with the proceeds of a crime.

Before the bill was made law, and before hearings were held to get public input on the bill, Freedom Party of Ontario's Paul McKeever appeared on Rhonda London Live to discuss the legislation (see Part 3). He was preceded on the show by Dr. Margaret Beare, Director, Nathanson Centre for the Study of Organized Crime at York University (this part); and by then Staff Superintendent Rocco Cleveland, Head of Detective Support for the Toronto Police Service (see Part 2).

It is a terrible shame in my country my fellow citizens are numb and asleep to what is going on legally. Our forefathers Screamed the warnings year after year to keep the government in check and to keep a close eye on the machinations of government. We have become the most APATHETIC nation on this earth. I am so ashamed that my fellow citizens are not awake. I have four friends who scream out the warnings to everyone, but they do not have ears to hear. God save us.

There are checks and balances. Organized Crime is rampant in Canada. Time to wake up and smell the shit that is all around you. Besides, the money doesn't even go to the police agencies what motive would there be for abuse? It's not set up like the US. Do you even know the checks and balances law enforcement has to go through to have an application pushed through CRIA? Come on now. If you concentrated your energy on helping the "good" people you may have better results.

Hi Thrussy, whether or not the the legislation is currently being abused is absolutely irrelevant. What is important is whether or not it *can* be abused. If there are loopholes and vagueness in the laws, its a citizens right to question and close them.  Relying on your personal assurances just doesn't cut it.

The Civil Remedies Forfeiture process is not only needed in this country. It should be should be taught to all officers. If the "freedom party" would actually take the time to look into the cases being put forward instead of bringing up hypothetical scenarios like bogus claims about drug houses ect.. than maybe they would see that this legislations is not being abused. Get your head out of your ass and do some real research on the subject.
