Fireworks Bans

In a time when a welding spark or a cigarette can start a wildfire, should governments be able to ban fireworks?

It's a question on the minds of county commissioners again.

At the Truckload Fireworks stand on 191 between Midland and Odessa, the owner is not quite ready for the season yet.

But in two weeks, on June 24, the doors will open and the sales will begin.

A few years ago, Midland's Commissioners tried to turn the fire danger into an emergency situation, and ban all fireworks use, which is not in state law.

A local retailer sued, and the issue is still hung up in court on technicalities.

County Commissioner Robin Donnely says, "It was discussed and we did have citizens from the community come to the court and ask us to do that. At this time we're in a lawsuit, so we're kinda in one of those situations where we have to see what the final verdict is."

So Midland today followed state law, which allows them to ban rockets with sticks and missiles with fins.

Everything else is on the market.

In Ector County, someone said they'd heard the Governor would issue a list of disaster declaration counties before the end of the week, and any county on the list would be able to ban fireworks completely.

So they tabled the decision, and called a special meeting for Friday morning.

It turned out not to be true, so the meeting Monday will likely approve the ban of rockets and missiles only.

"This is the first time in fifteen years that we've had this continual burn ban this long."
