The state of Arizona is accusing Bank of America is impeding a fraud probe against the state. The investigation was launched the state in 2010 looking into allegations that the bank had "repeatedly has deceived" homeowners who were looking for mortgage modifications. But Bank of America is making it is difficult as humanly possible for them to conduct the investigation. And it turns out they have just decided to go with straight up payoffs.

this seems to be the american way.arizona should have supoena'd some of the victims and gotten statements before giving the bank a heads up.alternatively,unless boa is prepared to adjust all the mortgages in question,then the state has plenty of witnesses.

Don't they do this in the settlement of lawsuits all the time? If you agree to a settlement then you have to agree to never discuss the terms of settlement with anyone.

I believe Wells Fargo has done some pre-damage control as well, but not to the extent of BofA. For the new year of 2012 WF made a major change to their "Arbitration Language." WF account holders had to agree to the new terms which outline the fact that an account holder cannot take WF to court with a judge and jury, and in fact, made it so a person's only action is small claims court where the cap in the suit is limited, varying by state.
