Cop pulls over Driver for making right hand turn from middle lane. But it's actually legal.

REXBURG - An accident almost occurred here at the intersection of 7th south and University Boulevard because one driver followed a law that most people weren't aware of.

"The reason I'm stopping you. You took a right hand turn from the straight lane," said Rexburg Policeman Lyndon Barron.

"There's a sign that says you can do that," explained the driver.

Officer Lyndon Barron took the driver at her word, and sure enough there was a sign.

"And then when you pull up to the intersection it's only marked in the one lane. And that was brought to our attention by one of our officers," said Sergeant Rick Schmitt.

Drivers heading from this direction don't exactly expect someone turn right out of the middle lane, which is why they need to pay extra attention.

"The City Engineer indicated they just need to put more paint down and they're not going to do that until spring time and it's winter time. We're going to have snow, so you won't be able to see the marking anyway," explained SGT. Schmitt.

The intersection is also fairly new, adding to the confusion. But the reason a right turn from the middle lane is even allowed is because at 9am when students rush to the University, traffic is a mess, and the city decided that two turn lanes would be the best solution to the traffic. So until Spring comes, just beware that the painted lines don't reveal everything you need to know about this intersection.
