TITLE 18, PART 1, CHAPTER 33, Sec. 716. - Police badges

(a) Whoever -

(1) knowingly transfers, transports, or receives, in interstate or foreign commerce, a counterfeit police badge;

(2) knowingly transfers, in interstate or foreign commerce, a genuine police badge to an individual, knowing that such individual is not authorized to possess it under the law of the place in which the badge is the official badge of the police;

(3) knowingly receives a genuine police badge in a transfer prohibited by paragraph (2); or

(4) being a person not authorized to possess a genuine police badge under the law of the place in which the badge is the official badge of the police, knowingly transports that badge in interstate or foreign commerce, shall be fined under this title or imprisoned not more than 6 months, or both.

(b) It is a defense to a prosecution under this section that the badge is used or is intended to be used exclusively -

(1) as a memento, or in a collection or exhibit;

(2) for decorative purposes;

(3) for a dramatic presentation, such as a theatrical, film, or television production; or

(4) for any other recreational purpose.

  • @thepackripper89 Unfortunately, despite you being a LEO which I respect immensely, you are incorrect. You are incorrect according to an attorney, an FBI agent, and a federal judge. TITLE 18, PART 1, CHAPTER 33, Sec. 716b explicitly and clearly states it is allowable if the federal badge is a momento, in a collection, purely decorative, or for a dramatic presentation, or other recreational uses.

  • @ekProductions00 It's illegal to own any Federal Badge PERIOD. You can own any police badge you want, please feel free. Also badge collecting is a very serious hobby, and it's only easy for me, because I'm on the job. Most police officers think it's illegal to own any police badge, when it's only illegal to own a Federal Agency badge, or use a police badge to impersonate a sworn officer.

  • @thepackripper89 Um... a plain text reading of TITLE 18, PART 1, CHAPTER 33, Sec. 716b clearly states it is not illegal when certain circumstances are present. Anyone versed in legal interpretation could tell you that.

  • @thepackripper89 yes, i realize that, but i truly don't want to give off information to anyone what so ever. i wouldn't even feel safe if you were the president. i really don't want to have to talk to people about these kind of things. i have arrested someone before. a drunk guy who threatened to kill my son. i told him and showed my badge wallet. he atempted to hit me, but i had a taser and used it. then, i handcuffed him, put him in my regular home car, and called the cops for pickup.

  • @shadsf342 You do realize that you would be calling a Phoenix Arizona POLICE Precinct. That is the number for supervisors aka me Captain.Sherman. Look the number up.

  • @thepackripper89 are u insane? i'm not telling you anything. you do realize that ANYONE can be on the internet and decide to steal someones identity. thats a red flag right there that something is wrong. maybe i didn't explain good enough. i didnt literally pay for a badge. i got it for paying bail on people proven innocent, and have done many hours of community service, and was required to look over state laws, and have a certain number of hours of firearm and emergency training.
