From what I know the rights to the actual game is still in the hands of former 3DR, Take 2 had the rights to distribute the game - so a petition to Take 2 won´t matter much. What you need to gather is the cash to finish the game and have a contract with 3DR that they need to finish the game within a certain amount of time (otherwise you loose your cash).

Take 2 were the ones who helped fund the game. They did have a contract where they should finish the game but they failed to do so which is why Take 2 are suing 3d realms. People wouldn't put their money towards the game as they will probably think some shyster is trying to steal their money and also 3d realms will need a hell of alot of cash.
