The NY Senate defeats a bill supporting same sex marriages 38-24. SkunkPoster Aaron Smith gives his opinion on the WNY state senators and their lack of effort to support basic civil rights.

It is truly unfortunate that we live in a society that cannot embrace the simplest of civil rights. With the 38-24 defeat of the same sex marriage bill in the New York Senate, Gov. Paterson was quoted as saying, "We need to make the climate safer for people who were sitting in this chamber (State Senate) who believe in gay marriage but didn't have the intestinal fortitude to vote for it." It is shocking to me that we have to make it safer for people to do the right thing. Government official are too worried about their careers and not focused on doing the right thing.

I have hope that one day, hopefully in the near future, New York State will join the ranks of states that allow same sex marriages, not because we should do it, but because it is a basic civil right and it has to be done.

  • therefore, Same sex couples do not have a SPECIAL right to redefine marriage for everybody else; the " will of the people" have a FUNDAMENTAL right under the tenth amendment to do such a task because we live in a democracy not an aristocracy. In baker v. nelson, the case called citizens for equal protection will show you in their conclusion that citizens do have a right to vote on rights just as long as they are NEW rights , such as same sex marriage.

  • if you Go to Wikipedia and type in Baker v. Nelson, The case will show you that the same court in Loving v Virginia not only distinguished same sex marriage from interracial marriage, but established it as a right that does not exist under the constitution and never did.

    so the 14th amendment does not confer a RIGHT to gay marriage anymore than it does for polygamy

  • Read the 14th amendment. We do not have an absolute democracy. For example, we cannot vote to end the right to free speech or end the right to due process. We cannot vote to bring back slavery. We have a constitution that limits the government's power. The founders were very wary of the dangers of tyranny of the majority, and that's exactly what you propose.

  • in issue dealing with public policy, we actually do have a constitutional right to use the government to stop it with the power of democracy

  • Single parents are allowed to raise children. Those are motherless and fatherless homes. But two parents are better than one.

    Government is not about social engineering anyway. It's about the protection of the rights of individuals from the rights of other individuals. Until a gay marriage actually hurts you, you don't have the right to use the government to stop it.

  • The government is for everyone, not just children, or couples with children. The government should not be promoting more children. There are more children than straight society certainly can handle.

    But even if it is just about children, it's in the interest of children for there to be more and better homes for them to be in when they can't be with their biological parents or when their biological parents can't handle the responsibility.

  • the state has a interest in PROMOTING procreation into an environment where theres two biological married parents present the state does not just want to promote the ideal environment for children but they want to promote the common good through ensuring the well being of children

    by infusing same sex couples as apart of that meaning and word, you would not only promote motherless and fatherless environments but prioritize the needs and desires of adults over the needs of children

  • That doesn't make any sense. People are trying to use their RELIGIOUS beliefs to deny people marriage. There is no valid public-policy basis behind it.
