The A.C.L.U. arguments concerning the right to assembly prevailed with a local court, and Occupy Delaware received a permit to encamp at Spencer Plaza. The Occupiers had been denied the right to use the plaza, and were forced to sleep without shelters on a public sidewalk for two nights before receiving the permit.
