When Santa Cruz activist Susan Zeman was cut off from oral communications, although she had waited in line and been assured she would be allowed to speak, homeless activist Robert Norse objected with a brief, "fascist salute." City Councilmember Tim Fitzmaurice objected and Norse was subsequently arrested. All charges of "disrupting a public meeting" were later dropped. Norse is currently awaiting judgment on an appeal to the 9th Circuit Court on whether he will be allowed to go to trial before a jury to determine if his gesture constituted "a disruption." Becky Johnson filmed the event on March 12, 2002.

  • Uhmmm. Not sure who you are referring to. The current Mayor? That would be RYAN COONERTY, a real "gem". Ryan has cut back public comment at City Council meetings so drastically, he now violates the Brown Act at each meeting. We (the public) must BEG a council member to pull items off of the consent agenda for discussion! California's Brown Act mandates public comment on EVERY ITEM. He has made playing a flute too near a statue, a crime.

  • Nice observation, ramm! Yup, it was a pretty wimpy "Nazi" salute. Too brief. The wrong hand. The real Nazi's would have shot him for making such a poor salute.

  • Shockingly, on Nov. 3, 2009, the 9th Circuit Court of Appeals ruled against Mr. Norse and in favor of the Santa Cruz City Council. A more blatant error of law can hardly be imagined, but it is what it is, I guess. If you can get kicked out of a public council meeting merely for making a silent hand gesture, then "freedom of speech" and freedom to "petition the government for redress of grievances" no longer exists.

    in a rare, en banc hearing sometime in June.

    Go figure.

  • Because it had nothing to do with Jews. His gesture was meant to mean "You're acting like a bunch of fascists". Krohn, Porter, Kennedy, Primack, and Fitzmaurice are not Jewish. Later, Fitzmaurice claimed that his wife, who is Jewish, would have been offended. Fitzmaurice' wife was not there at the time.

    he's a hero for refusing to leave the meeting and then for fighting this thing in court for eight years.

    and yes, americans died fighting the nazis. so why should we tolerate it when our elected officials act like nazis themselves and violate our rights like the city council and that whiny little fascist coward Tim Fitzmaurice did? we shouldn't, we should stand up for our rights, like Robert Norse did.

  • This is the first time I've ever watched a youtube video because it was cited in a US Court of Appeals opinion. Judge Kozinski is the man. Both his opinion and Judge Thomas' ruling in Norse v. City of Santa Cruz are both excellent legal writing and highly entertaining.
