Did the petition filed against you by a debt collector include a warning that "this is an effort to collect a debt?" Go to http://YourLegalLegUp.com to find out your rights. If your lawsuit includes a notice that "this is a communication from a debt collector," you may be able to file a counterclaim based on the FDCPA. YOU STILL HAVE TO FILE YOUR ANSWER!   • Good to know that the debt collectors can still file a petition even if they've failed to validate the debt. Thanks to you, I'll always answer a petition. I've had a few debt collectors call recently and verify my address and they've failed to send their standard letter at all. That's never happened in the past. I wonder if they can file a petition and never deliver it to me.
