"Hi, my name is attorney Jeffrey Bussell and I head our law firm's pre-lawsuit division One of the most common calls we get is related to the mini-tort case. A mini-tort claim is essentially your collision damage claim only. It's for your physical damage to your vehicle. In Michigan, if you were hit by another driver, and the other driver has insurance on their vehicle, the most you can get from them in $500. And that's for physical damage to the vehicle only.

The easiest way to pursue a mini-tort claim in the vast majority of cases, is to send a letter to the insurance company of the wrong-doer in the car accident, and add three documents to that letter:

1. A copy of the police report showing the other person to be at fault.

2. A copy of the declaration page from your own insurance policy, which shows all of your coverages and what you pay for them.

3. A damage estimate for your vehicle (If the damage estimate is impractical or it's hard to get because your car is in salvage or you can't get it to a dealer or some other type of shop for an estimate, then photos will suffice. If you're going to get photos of the car, see if you can get the license plate in the photo).
