Sexualisation of children, tweens and teens in media is a big concern, so is sexualisation of children, tweens and teens on the pretext of art or elitist notions. Minors cannot give legal permissions, neither do they have the maturity to give out one. Neither do their parents or any adult have the right to give permissions for so called nude art. If Tony's background (with well defined moral values and boundaries) is good enough to label him a pedo, then the secular (atheist) values with no foundations to base any moral values is a compelling case for a pedo label. If the religious background of a person is important in relation to a crime, then I reckon the secular (atheistic)values of a person is equally important in a crime.

Then why is downloading or storing nude pics of children criminal? Well, many children are nude to certain degrees on the beach but will it be ok for some one to take pics of them and store them on the camera or computer or exhibit them as art?
