  • @bbburton The Constitution is just a god damned piece of paper. It doesn't mean anything and it's horribly outdated for the 21st Century.

  • That is not true. Amd 16 as it states in plain language gives congress to right to tax income. It does not give Congress any other right. How you get from there to giving Cong the ability to enforce federal law is beyond comprehension and logic. And yes, the 14th Amd specifically bestows citizenship on those individuals born in the US, excluding Indians. And your citing of Art 6 is totally out of context. Why do you think the first 10 Amd's were passed? Congress can't do whatever it wants.

    Amendment 16 removes the need for apportionment.

    Which makes all the difference. Effectively giving congress power of tax revenue reimbursement. Effectively giving congress the ability to enforce federal law. (Unless specific state governments are suicidal)

    And no, the Supremacy Clause doesn't only cover immigration.

  • Supremacy as to citizenship only. You need to read Amend 10 for what it actually says, not what you want it to say. It specifically denies the federal gov from exercising powers not expressly given to it, and gives the states and the people everything else not expressly denied by the Const. That's a far cry from your position. Again, Amd. 16 refers only to taxation, nothing else. It does not give Congress any other additional powers. it should be repealed as unconst'l as it violates Amd 5.

    Indeed.

    Amendment 14 also has this thing called the "Supremacy Clause". Where federal law overrules state law.

    And while Amendment 10 allows states to ignore federal law, Amendment 16 allows the federal government to punish states for doing so by withholding reimbursement of tax revenues. (16 specifically made it so that reimbursement doesn't need to be proportional to population)

    So in effect you have one law which makes federal law supreme, and another which makes it binding.

  • What a stretch. No, that's just plain fantasy. Amend's 14 and 15 guarantee citizenship, equal treatment by the states, and voting rights. Amend 16 is about income tax. That you could get from there to Congress can do anything it wants is laughable. As if those amend's negate the rest of the Const. Try again, and this time cite a specific power that is enumerated that gives Congress the powers to rule our lives. I'll give you a hint - it doesn't exist. I refer you to Amend's 9 and 10.
