@TheVjey1985 Obviously, strictly its out. The ball was never going to hit the stumps however, its pretty bad sportsmanship IMO. Its one of those things that the rules weren't written for.
Similar to batsmen handling the ball, it sometimes is a bit of a grey area when the ball is "dead".
As an Australian anything Steve Waugh does / did is obviously perfectly fine heh :)
Ive seen batsmen fend the ball away often, happened more in the past it seems, is the rule being in the crease or not?

He was out of the crease long way. Its the fielder's choice to throw at the stumps. He blocked it but should have turned back and tried to reach the crease. So that is out well within the rule.
Steve Waugh did the same thing in a more elaborate manner. He tried blocking the ball with his hands against the same opposition. That is an entirely different story :P
