actually breaking the eula is illegal, as the eula is what allows you to make a copy (I.e install the software).
When you break the eula, copyright law means you can't install or use it.

To own one is breaking the eula but is still legal,selling is breaking the dmca which is illegal.

psystar are charged since they are modifiing the OS. that is however illigal for sales.
If the machine is "capable" of OSX and the osx sold seperatly there is no problem.
But psystar are running on a modfied kernel.

Psytar lost the summary judgement in California. What they're doing IS illegal, it's against the EULA and against the DMCA. Apple doesn't really care so much about OSX86, it's a personal project. There's a MASSIVE difference between "for personal use" and actually SELLING it. What Psystar are doing is 100% illegal, even in the EU it would be illegal. Commercial and personal are NOT the same thing. It's like copying a CD for personal back up, that's fine, but if you sold those copies, illegal.

If they are only breaking Eula then its perfectly legal.
In EU this is a open n shut case. Apple would loose, as loong as it is a legit copy of OSX.
Only in the US would this be a problem.

If I buy something in the EU I can do whatever I whant with it for personal use. I can make it to a toaster and stick it up my ass if I would like to.
I had a AMD hackintosh for long time it ran fine it now runs Dream Linux because I see no benefit of OSX over Linux when Linux is just as good if not better and its 100% free and legal.
As for psystar, you can run OSX on a $200 netbook if that was your thing and for cheaper.

This is bad news for hackintosh users like us...we keep discrete about hackintosh..but this Psystar bullshit takes advantage of it...now apple will be aware of this and tighten their OSX security not to run in non apple hardwares!!
