Under the House bill:
(3) COVERAGE UNDER PUBLIC HEALTH INSURANCE OPTION.—The public health insurance option shall provide coverage for services described in paragraph (4)(B)."
And paragraphi (4)(B) reads:
"ABORTIONS FOR WHICH PUBLIC FUNDING IS ALLOWED.—The services described in this subparagraph are abortions for which the expenditure of Federal funds appropriated for the Department of Health and Human Services is permitted, based on the law".
Governing law is Hyde Park amendment.

So what if unsubsidized public option plan covers abortion. That's no different than private plans now.
Yes the Hyde Amendment applies only to the ...HHS. So what was the reason for the bill mentioning it for purposes of the public option? If you read it correctly it means that the abortion rules applicable to the Hyde Amendment will apply to the public option also. In other words the bill would have been abortion neutral - just going with the existing law - Hyde Amendment.

HR 3200, Section (4) (B). "Nothing in this Act shall be construed as preventing the public health option from providing for...abortions for which public funding is prohibited." (This was before the Stupak Amendment was added.) Also, the Hyde Amendment applies only to public $ appropriated through the annual HHS appropriations bill. Thus, it doesn't apply to any of the public $ used to establish or operate the abortion components of Obamacare.
