I take issue with D'Souza's analogy of thinking about killing someone, so you will be charged with attempted murder. You cannot be sentenced for thinking about murdering. But you can be charged with plotting to murder because that is a physical action. Intention alone does not hurt people, but the resultant actions are the things we judge, otherwise, we must appease people like Paul Jennings Hill, since his actions, though despicable, were done with the intentions of protecting unborn children.

Can someone "accidentally" kick a dog to death? You cannot compare the action of falling to the action of kicking. What a blurred reality Mr. D'Souza resides in.
Mr. Barker is merely remarking that intentions do not hurt people, but it is their actions and that is how we must judge others. With regards to murder and manslaughter, yes the difference is indeed intention, but intention is only taken into account to properly assess the judged action, not directly because of the intention.
