T H I S IS T H E P R O O F ! BOYCOTT TYSON FOODS VIDEO 001 DANIEL J. KIDD & PBT v ARK.WORK.COMP.COMM. & -TYSON FOODS, INC.-TYNET Unbelievably, the state government of Arkansas has allowed it second largest employer and political contributor to actually dictate the laws of the state of Arkansas. In this case, the current workers' compensation laws of Arkansas were written by the current head of Tyson Foods, Inc.-Tynet. Therefore, as in the case of Daniel Joseph Kidd, (who was poisoned for 18 months by Tyson Foods Berryville Production Line 10's smoke & natural gas leaking fryers and is still suffering permanent damage due to CARBON MONOXIDE, SMOKE INHALATION AND HEAT EXHAUSTION), was denied the right to file work comp, by Tyson's nurses for 18 months. Then when Kidd's wife filed the paperwork, it was denied even though Berryville's Complex Manager, Michael Armstrong, promised to help Kidd get Work Comp. Armstrong also promised Kidd 3 months of short term disability and then 2 years of long term disability, that Kidd paid for. After Armstrong, two nurses, two people from safety, and plant manager Roger Nance, had a PRIVATE and "unprecedented" meeting with Kidd's personal physician for 40 minutes within Kidd being allowed to attend the meeting, even though he had a written excuse by his doctor to do so. Kidd was not allowed into the meeting by his supervisor, Danny Tumbleson. It was Kidd's doctor that convinced Armstrong to allowed Kidd into this meeting, (June 23, 2010 1pm), to explain his symptoms to Armstrong. After Kidd mentioned that he had been having seizures and momentary blackouts on the line when working near the fryers of Line 10, (Tyson's Domino's Pizza line), Armstrong stated the following. "I can't let you, (Kidd) back out on the floor. You're a danger to yourself and others. I'm going to put you on medical leave. Do you agree Dr. Richter?" Kidd's own personal physician agreed. In the end, Kidd was forced home on medical leave. Armstrong even told Kidd as the meeting was ending that he would have the nurses help him fill out the paperwork for Arkansas Workers Comp. Kidd informed Armstrong that his wife had already called the Arkansas Workmans' Compensation and they helped her fill out the paperwork just days before this meeting. After being sent home, Kidd received 2 checks of $108.00, one for appx. $65.00 for his short term disability, and has been fighting Tynet and Unum for his long term disability. Kidd applied and was approved disability by the Social Security Administration in August of 2010, yet he would not receive any payments until January 2011. Tyson has cut off ALL of Kidd's health insurance. Kidd has retained lawyers but ANOTHER LAW, WRITTEN BY TYSON, IS BLOCKING A LAWSUIT AGAINST TYSON. Tyson and other large corporations in Arkansas "conned" the Arkansas Legislator into adopting a law that forbids ANY personal injury lawsuit against the corporations. The "con" was, this law would bring more industry to Arkansas. It hasn't. Unum, Tyson's 3rd party insurance carrier, (Google Unum Lawsuit and you will see they have a bad history since 2002, the year Tyson signed up with Unum), has danced around Kidd's claim, saying that smoking was the cause of his CO poisoning, plus he had pre-existing mental health condition, (Agoraphobia- fear of traveling-something Kidd never had a problem with a Tyson and Tyson knew about it from his pre-employment physical), YET, Unum has still not denied Kidd's claim. Why, if they do, this opens a "back door" to sue Tyson and Unum, since Kidd didn't ask for long term disability, when offered in 2008, yet TYSON put Kidd on it regardless, and took premiums out of his check. Kidd has gone without an income since late July 2010 and is forbidden to work anywhere due to still being on medical leave with Tyson, plus the risk of losing his Social Security payments to come. Unum is stalling until after Kidd receives his Social Security in that the payments from Unum would drop from $1,050.00 per month down to $250.00 per month. Since Kidd cannot sue Tyson or anyone else in court, he, along with the MENA group, are going to take Tyson, Tynet, and Unum to a different court. One that Tyson has shown GREAT FEAR OF in the past. The court of public opinion. His story, and many other employees from Tyson and UNUM is going nationwide. This is only the beginning. Filmmaker Michael Moore has been contacted to do a movie on Tyson. Other producers have been approached and it looks promising, especially when you dig into Tyson past.   • In late December of 2010, we presented this video to the legal adviser, commissioners, chairman, etc, of the Arkansas Workmans' Compensation Commission. To the date, they have not confirmed or denied the statement made in this video. They followed their routine and we answered back with the following videos. PBT-Mena
