This is a meeting with my Attorney at the courthouse, I'm trying to express my innocence without knowing all the facts and it shows.........
I am still having ongoing serious legal problems due to false information and testimony by a state farm insurance claims adjuster. My house caught fire by accident in Kansas City, Kansas on 29 May 2009.
I had an insurance policy by State Farm. After being injured in the fire and in the hospital my dad made a claim on my policy 2 June 09, the insurance adjuster had contacted me (over the phone) about details of the claim under policy, 3 June 09. He told me I could accept payments under a "loss of use" clause for displacement. At that time I expressed disapproval of the claim, the Insurance adjuster, Mike Haire of Topeka Kansas, had deliberately without my knowledge, paid money on this falsely created claim. Once the claim was created by him, State Farm used this as evidence against me for insurance fraud, a warrant was issued for my arrest and then the insurance company collaberated to make these payments as evidence in a future trial. On my last day in the hospital, 1 July 2009 I was paid a visit by the Kansas City, Kansas Fire Chief, Randall L. Hockett. In my statement under oath I maintained my innocence re- affirming the cause had been an accident. On 7 July a warrant was issued for my arrest, I promptly bailed myself out, paying 10% of $25,000 bond on 16 July 09. The insurance company issued checks to my father starting on 11 June 09, by way of the falsely created claim of State Farm.
I Hired an attorney, 4 Sept 09, Steven D. Alexander of Barnett law firm located in Wyabdotte Co, Kansas City Kansas. I was given a pre-trial date of 31 Dec 2009, at this hearing the state's two main witness's were Mr. Hockett (focusing on cause) and Mike Haire, representing state farm, who had intentionally withheld information that payments were made to a 3rd party person (my father) claiming I had in some way benefited from these payments. Under homeowner policy guidelines it is required that 3rd party persons be present in hearings and at the hands of the Kansas State prosecutor, Casey Meyer had collaborated with the insurance company, marked my father as a witness in that preliminary and then denied his testimony at the last minute to force him out of the court. At this hearing was the first time I was aware monies had been paid, and my father could have testified as to what exactly happened. The original evidence on my warrant, listed by Mr. Hockett regarding tests by State Farm, was later proven to be false. In light of this unethical behavior, per my agreement with my lawyer I was required to pay addition fees (if necessary)for services rendered by experts to help my defense in cause which I did. I hired Curt Huckshorn, of Belton MO, and after the $2000 retainer I was nearly bankrupt, my lawyer pressured me to hire additional experts in an effort to push this through to the court without my best interest or proper defense of this case. My lawyer is attempting to withdrawal from defending me even though I have made a valid argument as to a defense which does not make an expert necessary under our agreement. I was sentenced in this case 28 JAN 11, I've been ordered 2yrs of probation. The basis of my appeal was the Fire Marshall violated a Physician-Patient Priveledge by Eavesdropping and put private information on the warrant for my arrest. I did not find this out until after the trial when I recieved the State Farm Log book and this statement was given by the FD to the insurance co before the investigation was complete. UPDATE: I am on appeal for this arson charge, the last document I recieved about this issue was from the Kansas Court of Appeals stating that my case has been assigned for review. As soon as this step is complete I will know if I get docketed for a future re-trial date.

Imposed Sentencing was on 28th January 2011, the Judge Burdette who never looked at the new evidence, denied N.O.V. and Arrest of Judgement motions. Instead I was forced to probation with the following terms which is violation of the rights of the accused and 4th amd. secure persons.1. Permit court/correction officers to tour your home. 2. Not to carry a weapon/firearm. 3. Submit DNA blood sample to lab and pay for testing. Failure to comply is a seperate charge of probation violation&prison.

I never spoke with anyone at the Sheriff's Department, but I did in fact tell the nurses when I was burned in Kansas City to inform them I had not had medical attention in over 24hrs. The first Breach of Privacy occurred when Chief Hockett acquired information relevant only to my care from the deputy at the Cherry County Hospital by eavesdropping. The second violation of my Rights to Privacy was by Mr. Hockett gathering personal information from a nurse without my permission or knowledge.

Update*
After 3 days in court ending 10 NOV 2010 the Jury found me guilty of criminal charges, ARSON/KSA 21-3718 -damaging any building which is a dwelling with intent to injure or defraud an insurer or lien holder. With that said, pay attention to that last part, defraud an insurer, cause thats the only thing which would apply in this case.Look @ Fraud by State Farm 2 of 2 ,warrant, do you think probable cause was evident?
There was no mention of my actions regarding insurance at all. NONE

Soooo, who is the person in the video with the BURNS? You?. Well even if you didn't claim monies, YOU BURNED THE HOUSE... Duhhhh - That is why you don't want to CLAIM any money. To drop the fraud charges... SEE YA! "Jail"

@jwgizmo1 Your missing the point completely. The initial charges stem from false testimony by the insurance agent Mike Haire. He paid money to my father, then testified that I had something to do with it, I can actually prove I wasn't even aware of the claim. The first check was sent to my dad while I was in the hospital.
