I see no valid crime unless they can prove that Ellis has uploaded albums to the website and are petty enough to prosecute him on those grounds. Are they then going to turn around and prosecute every one of the 180,000 users too? Doubtful.

I don't see any weight in their claims against him. He's only provided a method to share, not the product itself.. if they sue him, they should sue the makers of utorrent, limewire, ares, emule etc. they are also providing a method to share files. There's no difference between him and them.
