Rather Ditzy Girl Performs Sobriety Test

An Ohio State Trooper pulls over a young tipsy/ditzy girl in a Wal-Mart parking lot and performs a sobriety test. This trooper is definitely what you call a "good cop", after he somehow keeps a straight face when he asks her to count nine heal-to-toe steps on the line, and instead she counts to three, three times... atleast she's got her multiplication down.

"Do you have any medical problems that would prohibit you from standing on one foot?"
"Uh... allergies."

@fishman017 If she did not pass the tests then that is probable cause to arrest her. Even if she is found not gulity to a DUI charge, enjoy the couple grand in lawyer fees fighting it.

Unless the officer performed a field breathalyzer, a station breathalyzer or a blood test at the hospital, the county/city would have trouble proving DUI or DWAI. The "per se" concession still requires proof of intoxication, not mere perception. My guess would be the officer detained her, took her to HQ and did a formal BA, which she likely took. At that point she likely blew over .05 or maybe even .08. If she refused, her license was suspended for 1 year, which was probably better than the DUI.

@InhumaneClient Not once did she fall down. She may have been slightly impaired or not these tests don't show it. The eye test we can't see so can't be sure about that one other than that she did okay on the actual test.

Cop had difficulty holding up foot for a much shorter length of time these tests aren't that easy if someone is actually drunk they will do much worse than she did.

@88gibsonsg Actually this is evidence for the defense also as she didn't look drunk to me, although it was cut somewhere in the middle so don't know what part was cut out, maybe that was why he thought her drunk as nothing shown indicates it.

3x3 equals 9 the girl knew that and the cop didn't. He said take 9 steps he did not say count to 9. He said take steps up to 9 not count up to 9. So guess they girl is smarter than the cop. He said to take 9 steps which she did and in his example he counted to 3 so 3X3=9 so she did exactly as he asked.
