Monica Goodling, who was supposed to testify before Congress on Thursday, has decided to plead the Fifth Amendment. So the question most people want answered is whether that is legal?

John Dean, former White House Counsel to Richard Nixon, explained that you can not just plead the fifth unless your testimony might lead to self-incrimination. Dean spoke on Wednesday night and hinted that she might be immunized by Congress and then be forced to testify. Or, quite possibly, the Judiciary Committee could declare the Justice Department or White House in contempt of Congress. The showdown is just beginning:

  • Iennhart ~ Aptly said. What's next for the Neocons? Is it possible that they hijack America deeper and more profoundly? If they continue altering our identity that is our Bill of Rights, we should no longer go by our old name, America. Bush and Cheney might want to keep the name but change its face and guts.

  • You may tell them to take a hike or you may tell them to hold you in contempt as well, but that doesn't mean they will run away with their tails between their legs, it means you would be jailed, tried and convicted.

    You can TELL them to take as many hikes as you want, but that really doesn't empower you, it commits you.

    The 5th ammendment applies when your testimony may incriminate YOU, not somebody else.

  • It is illegal to refuse to testify in front of congress. Executive priveledge does not apply to people who are not in the executive branch and are not even employed by them anymore. Bush is clearly in contempt of Congress as is Harriet and any other person refusing to testify.

    This isn't Judge Judy, this is the Congress of the United States and nobody, including the president has any right to refuse to testify. This is our system of checks and balances and apparently, we need it very much.

  • She has taken the fifth because she realizes these Democrats are out to get whoever they can for whatever they can make up. I would tell them to take a hike.

  • The GOP has ceased to be a political party. It's a crime syndicate.

  • Democrats can hold me in contempt of Congress as well. I have nothing but contempt for them, both Democrats and Republicans.

  • people MUST start refering to this as MONICAGATE! how rich!
