2. Two Alabama women have filed what is believed to be the first personal injury class action involving a chemical dispersant in Alabama federal court. The women allege BP has dumped millions of gallons of toxic chemicals into the Gulf of Mexico to disperse and sink crude oil to the Gulf floor.
3. Meanwhile, BP was hit with a class action lawsuit in Texas federal court August 3rd. The company is accused of endangering the health of Texas City, Texas, residents after an alleged leak of toxic chemicals at its refinery there.
4. LexisNexis Mealey's Emerging Drugs & Devices Editor Tom Moylan explains that the Third Circuit U.S. Court of Appeals has affirmed that manufacturing defect and breach of warranty claims involving the Vagus Nerve Stimulation Therapy System made by Cyberonics Incorporated are expressly preempted.
5. In notes to its second-quarter financial report, AstraZeneca said that as of July 27, it has agreed in principle to settle with nearly 4,000 Seroquel product liability plaintiffs.
6. The U.S. Environmental Protection Agency in late July denied 10 petitions challenging its determination that greenhouse gas emissions are a threat to public health and must be regulated under the Clean Air Act.
7. A second student has sued the Lower Merion School District in suburban Philadelphia, again accusing it of spying on its students via webcams on district-issued laptops.
