I've got an even better solution: Nationalize all oil & coal production. That way the EPA sets the guidelines, the national company complies, and voila. No middle party, no court-BS to handle the consequences of an oilspill, quicker & better decision-making on exploration etc.
Best of all? The US govt gets all the profit from it, all the oil & coal is used within the US (not exported), and if an incident happens, the US govt pays as always, only this time they've got money in the bank for it.
