The Right to Education Act 2009 makes it a fundamental right of every child in the age group of 6 to 14 years to have free and compulsory education sponsored by the State. However, it has not been able to help the children.
The Act has flaws such as the age group that it covers is 6 to 14 years and it does not consider the children below 6 years. No importance is given to pre-primary education and no consideration is given to the fact that many children start working at a very early age, long before they are six. It does not refer to the Child Labor (Prohibition and Regulation) Act, 1986 and does not categorically prohibit child labor.
The Act stipulates that the State must establish a school within the limits of neighborhood, in order to ensure free and compulsory education. However, there is no attempt made to define what a 'neighborhood' constitutes.
The Act came into being to help the needy. However, it is not designed keeping in mind the needs of the needy.
