point (2) you're right about the seed thing; under -real- laws seeds are only probably cause for search of the immediate presence and your person, but possession is not an arrestable offense.

drug dealing is the transfer of a finished product to the user; if you're not actively transporting or possessing plants or cuttings/leaves/baggies, you're defensibly exempt from inclusion into dealer status.
