How do you pick brightest and best without a test? No test is given to Americans, how do they innovate working as slaves for a body shop like Infosys, Wipro, Satyam or microshaft who has long history of stealing other peoples ideas. H1b was picked by lottery because there were more best and the brightest and US employers wanted to hire them. Since the quota was 67K they have to do a lottery system. We are heavily dependent on innovations and we need best brightest at any cost. We want candidates who are dedicated and who love their jobs and ready to put long hours to get results.

H1b are picked by a lottery - how can it possibly be best and brightest, Canada is not our enemy, I only had 1 emp give me an IQ test, so nobody is really looking for brightest and best they are looking for cheap slave labor. If Microsoft or these other places were really looking for smart people they would try too recruit smart Americans but they make zero effort to look for smart American worker, most do NOT recruit at American Universities.

Every H1-B pays tax and also pays Social Security and Medicare and when they leave in 6 years they dont get anything, one bcos they have not worked the mandatory 40 periods for SSN and secondly their countries wont help them raise this issue with the US govt. Friends understand that everyone whether indian or american is working hard to feed his family.

The problem is that there is no effort by DOL to make sure they leave when their visa expires. According to CIS, about 700K former H1Bs/L1s are still in the US with expired visas. For example, being in the que for a GC doesn't extend the visa. These guys waiting 10y for a GC are just being abused or deluded; if their employers REALLLY wanted to keep them, they would have them in one of the rare worker visa types.

Actually, H1B is repute to bring the B&B but in 1990 was designed to bring in CS/EE due to a shortfall during the early part of the IT build out( circa 1990-1995). There are other visa classes for "rare workers" but H1B is not designed, dispite what they say, to bring in the B&B. It can't is completely randon.
