Vapiano, a restaurant on the southeast corner of University Place and 13th Street in New York City, installed a "rack" of HVAC equipment in our residential courtyard in July 2010.

This equipment rack consists of a three story, forty foot tall steel structure with several commercial grade condenser units, a large "make up air" unit and a commercial exhaust fan.

The noise it generates makes many people's apartments unlivable.

This all started on July 16th 2010. It has been continuous and ongoing ever since. It is well in excess of the noise code and the Department of Environmental Protection has already found the system in violation five times and has issued three violations.

Every resident that faces the courtyard suffers terribly because of this continual aural assault.

The Department Of Buildings has issued 2 violations for the structure in the rear courtyard. One for "Work Without a Permit".

Somehow we have not been able to solve this issue with the various agencies.

  • The vibration from my downstairs neighbor's hvac unit has been invading my apt for three years. Mgmt company useless. Talking has not helped. Desk area (office) is unusable when his heating/ac unit is on.

  • @usherka1 yeah my parents live in Frankfurt/Germany and we have 2 Vapianos I think, but those restaurants are in areas where there are just offices and Ive never heard of any HVAC problems. I am wondering why this is different in NY. Seriously, if I go back to New York I WONT eat at Vapianos, even though i like the food. But what they are doing with their neighbours is too much. Im glad I saw this video

  • nothing about it anyway. I hope that they get a rid off the problem and they replace the restaurant or they shut it down completely.I definitely wont go there any more !

  • I am in shock!I am from germany and Vapiano it's my favorite restaurant,i use to go to Vapiano back in Berlin 4 times a week!I went to the one in NYC twice and now I regret it!it's a nightmare for me just to hear the noise on this 15 minutes video! I feel so sorry for all these neighbors and thank gosh they said something about it , it can't go like this,if I will be living there I will go curse the Vapiano owner out every day and night. The owner is a douche bag and he seems like he won't do

  • Nobody wants the restaurant to close, JUST END THE NOISE!

  • How is it possible that NYC allows this to continue? So what good are laws if no one enfoces them? Some big bucks must have changed hands at the government level, that's all I can think.

  • I live near Vapiano. There are so many good restaurants in the neighborhood, I don't need to eat there. I'm not going there until they remove this noise horror, and I urge my neighbors to avoid it as well.

  • What a shame I can't believe they didn't turn that thing off after the complaints! What a nightmare!
