I agree with CHopper.... who's Benji ever killed, he wouldn't have killed Dino, PK, Victor Pierce (they've already charged people over Pierce), Radev, etc. (Or, I don't think he would have)

Gatto acted in self defence, just as he said. Benji didn't go there to try and kill, but lost his cool when confronted by Gatto, pulled his revolver from the back of his pants.

Gatto, always the confrontasionalist, knew Benji and that it was a possibility for this to happen and was ready for it! (there's no way he'd go there without his gun) He's double parked out the front, incase he had to make a quike get-away.
