I was detained by Police in Romford after taking an image of a cadet unit who were about to march in a massive parade in front of thousands of people with cameras. I was told it was an offence to photograph a child, then an offence to photograph the military, then an offence to photograph the police then that I was a threat under the terrorism act. I was frog marched with my arm painfully twisted away from the public eye and any witnesses and pushed down a set of stairs. The police illegally tried to take my details on several occasions also.

    What is most relevant is that the seniour officer quotes use of a breach of the peace as grounds to detain the photographer which in itself is not a criminal offence, but the police and any other person does have a power of arrest where there are reasonable grounds for believing a breach of the peace is taking place or is imminent.

    You are right about the Terrorism Act 2000 section 58a,but subsection 3 allows for reasonable excuse, which in this scenario could be reasonably applied to argue that the taking of photographs of a police officer was for evidential purposes to prove harrassment and abuse of power.

    It is an offence under the Counter-Terrorism Act 2008 to publish or communicate a photograph of a constable (not including PCSOs), a member of the armed forces, or a member of the security services, which is of a kind likely to be useful to a person committing or preparing an act of terrorism. There is a defence of acting with a reasonable excuse, however the onus of proof is on the defence, under section 58A of the Terrorism Act 2000.

    I'm a Ex squaddie, and I'm getting pissed off with all this shit, that was fucking believable police abuse of power and harassment, It seems to be at epidemic proportions here and USA. I call it the STASI Power.I hope you put a official complaint against Inspector Fish & each officer concerned and keep on putting official complaints every time your stopped, harassed or questioned' as it goes on their police records too, then the police might tow the line. Before 911 not a thing would have said.
