  • Muklasky just wants to see some good ole Bush/Cheney style torture so they will see signed false confession that proves their preconceived ideas, instead of getting to the real truth. It's the conservative way of getting the job done!

  • NO non citizen is protected by Constitutional rule of law within the United States; unless under a treaty. Anyone who would provide stated protection, is in violation of the rule of law. The P-Act allows the Gov to treat citizens as enemy combatants, but I would argue that the "act" is in fact unconstitutional.

  • Just another in a long line of patsy "terrorists" under the employ of the United States' federal intelligence network.

    In that context, this whole dialogue is rather impotent.

  • Mukasey's notion of what the Constitution is has to be the most twisted interpretation I've ever heard, which is infected by American exceptionalism and ideological arrogance. I'm amazed to see a former Attorney General ignoring and dismissing the 14th Amendment, and the rights that it confers to ALL persons that come under the custody and jurisdiction of the United States. His ideology is but one more sample of evidence of how rotten the Bush administration really was.

  • Because it is. There's no such thing as perfection. The document was conceived and put together by human beings, who were brilliant, but human nonetheless. The Constitution is flawed, so much so, that the Framers left us a mechanism to amend it and correct it when necessary, which we have used 27 times. Obama's assertion about the Constitution being a flawed document is absolutely on point. You don't have to be an attorney or a constitutional scholar to understand this.

  • If these terrorists are breaking laws against US citizens then why would not the citizens have the right to have these people brought in a civilian court on American soil to stand trial for these crimes and punished?

  • If Bush and Cheney want to make the whole world "the battlefield" and turn crimes against US citizens into legitimate acts in a declared war then we as "innocent" civilians must therefore be combatants in this war and legitimate targets of that war. To call people who conduct war against legitmate targets terrorists is a reduction to absurdity. And to say that they are "unlawful combatants" when they either attack civilians or military is also reduced to absurdity. What laws are they breaki

  • And Mucasey saying that suspects are "intelligence assets" regardless of their human rights is outrageous. It begs the question of how one can ever know how much intelligence these criminals are privy too and what they are not. And if you torture someone to get information it may or may not be valid. So what good is that?
