King presents Jenkins' arguments. The BOE cannot hear his termination hearing, because they have already decided his fate. They have also been sued by Jenkins, so they cannot be impartial. Refers to The Citizen News article, "Jenkins Dodged the Bullet", that the BOE was going to fire him. Supt contract says that if he is to be terminated for just cause, any complaints must be given him and have the opportunity to investigate them before they are used to terminate him. Jenkins does not have the right to subpeona, only Chair can. Law empowering the Chair made in 1988-1989, at the time of the redistricting lawsuit, to maintain white control. If policies are wrong, were they wrong in 1988? Cook not on BOE until 1993. The three board members have complained to state BOE and Professional Standards, and are using those complaints to terminate Supt contract. They cannot hear the Supt termination hearing, it would be reversed.
