  • Hi Sir, I arrive here in USA may 2010 then i got married aug.2010 2 weeks before my K1 visa expired. It took us awhile to get married coz it was a Church wedding and need to attend seminars. its almost a year now i did not adjust my status yet coz of financial matters. would I be deported because i did not adjust my status right away? but were planning to file it next month. thank you hope to hear from you soon

  • @debzsays Thank you for posting your question. The most important thing is that you were married within the 90 day period. You can still adjust your status and you should do so as soon as possible. If the late filing of the adjustment petition is the only issue you don't need to be worried about getting deported.

  • Hi. thanks for your vid. My husband and i were looking into hiring an immigration attorney. I was wondering if my hub would have to go back to his homeland(Lithuania) to file an AOS. He entered the country legally but his visa has been expired for years. Do you know if he would be banned from the US for 10 years before being able to complete the AOS. Thanks so much!

  • @samba180 Hi, glad you liked the video. If you are a U.S. Citizen your husband would not likely have to go back to his country. As long as he entered, lawfully it does not matter for purposes of adjustment of status that he overstayed his visa. If you like a free evaluation of your case you can fill out my online form on my website.

  • excuse me, SO when ur on the US with a student visa you can apply to change visa status withtout the need of leaving the country at the usis?and how about , the "ON campus" JOb option on a f-1 Visa, is it ONly for Universities /COlleges or is it also posible for "esl institutes" or other educational institutes ?

  • @faridjabba Sorry, I must have missed this comment. In most cases you can apply to change visa status in the U.S. without having to leave the country if you are still in status and have otherwise honored the terms of your current visa. The office of international students at your educational institute should be able to help you with questions regarding on campus employment and other employment options that are available to F1 students.

  • Hi Sir,, thank you for the reply. I feel better now.

  • @pcurtislaw Thank you for your response:). Im headed to your site now.

  • @gregsil08 Hi, thanks for the comment. Whether or not you qualify for adjustment of status is really a matter of how you entered the country and whether or not an immigrant visa is immediately available to you. If you entered the country legally and are married to a U.S. Citizen you should qualify for adjustment of status even though you have been married for a year or more. You can email me through my website and we can discuss this in more detail.
