Buying the game doesn't give you a licence to the rights to the game. So its still illegal downloading a ROM or a Hack. The only exception is if you made the ROM or hack yourself, and don't share it with anyone. But its not really that big a deal. A semi-legal way to do a mod is making a patch for the game, but I don't think that would work with GBA, and you can still be sued, but you have a small chance of winning.
