You're Right and wrong. There is a joint ownership of the content. You own sole rights to it before you upload it. You grant YT and it's community a share of that ownership when you upload the video. It really is in the terms. VFX/PCS read that portion out loud with visuals, highlighting that once the video is removed that share of the copyright is revoked from YT and the community. He lost, and apologized for misusing the DMCA, THE SAME EXACT WAY GARY DID! doesn't look good for gary.

they've already been decided, time and time again. Name one instance where someone DMCAd a video, the second party counter-notified, and then the video wasn't re-instated? I can think of 4 Brett Keane videos that had the same case against SD, they are still up on his channel despite Brett Keane's numerous DMCAs. Gary WILL LOSE. Sorry to be the barer of what you perceive is bad news.
