This WH is really a bunch of idiots- WH Chief of Staff Jacob Lew explained away the Senate’s then-1,019-day failure to pass a budget by misleading Meet the Press. on Senate rules. He said that it that it takes 60 — and not 50. Senate rules dictate that a budget vote cannot be filibustered, and requires only a simple majority to pass.

@Jugheadr2 O.K. so I guess you are abandoning your original argument. Fine! Byrd and Pelosi didn't break any rules. First off, Pelosi is NOT in the Senate and Byrd was not Majority Leader. Even if they were, it would be their right whether to convene every 3 days or not. It really doesn't matter because the second they adjourn they are in recess anyway and the President is free to make RECESS APPOINTMENTS!

My infor is coming from the Senate website run by your people. Byrd and Pelosi broke the rules and Bush tagged them for it. They never officially went into recess, SEE their website. Democrats love braking the law just like Obama telling private companies what products they have to sell.

Obama even checked with the State Department to make sure he had the legal right to do this and they said YES! Congress has not challenged him in court so they must not think it was illegal either,

@Jugheadr2 According to your own time frame Congress was not out of session at the time of the Bush appointment! You wrote Congress was in session from Jan 4, 2007 to Dec 31. 2007, and then Jan. 3 2008 until Jan. 3, 2009. Therefore they were only in recess for 2 days (Jan 1, 2008 and Jan 2, 2008).

Since Bush did a recess appointment on April 7, 2007, then according to your argument he is violating the constitution. This appointment along with many others is illegal lol!
