The surest way to survive a gunfight is to avoid being in one in the first place. The second surest is to have proper skills and equipment as well as the mindset to properly employ them to stay alive.

"If I KNEW there was going to be a fight , I should have left. "
Yep...too true.

Clint Smith is the man!
I had the pleasure of training at Thunder Ranch, it was the best firearms training I have ever received!

That's correct if you're in the battlefield, but not on the streets of 'metropolis'. The purpose of a handgun is subjective and completely dependent on environment and the rule of law. Most jurisdictions will lock your ass up if you go to the corner ATM wielding a M1 Garand. The true purpose of a handgun is to convince an attacker that just because you're 25 min. from your primary weapon, you're not going to be a victim.

it is, you just forgo steps 1 and 2 in your scenario and you're good.
If you're being attacked, and you haven't done anything wrong, you're usually clear to use force. Although, sometimes just the threat of force is enough.

wish it was that simple

uhh, do you people even know how you get sent before a jury? Apparently not, so let me tell you.
First, your district attorney must charge you. If you don't get charged, you don't even see a jury.
Secondly, before you go carrying a damn loaded gun around you better read the concealed carry laws for your state and KNOW without a doubt what situations are legal for you to kill a person. If you do this, you're relatively safe from prosecution, because you will have shot the motherfucker legally

step 1: live in texas
step 2: shoot the badguy in the face
step 3: have a coke

I'd rather be like Clint too - Eastwood, that is, in dirty harry mode - and take pieces of trash down.
Shoot the liberal socialists jury too if they want to protect the criminals rights.
Handguns are to fight your way to a shotgun or rifle.

Again, sane advice. Too many "kill em" first "rambo guys" here. The reality is is that if you shoot someone in self defense, you better be able to convince a jury your life was in danger, and you better have at least 10 thousand dollars to fund a legal defense. Better to avoid if all possible. Stay armed, but be smart like Clint. ;)
