The fact people are crying about this proves how sad the american consumers really are. It clearly says used or new at the top. Learn to read, really that simple. But then again, this is the internet, where everybody must bitch and moan about everything.

seeing how they dont keep the disk in the case you could pick up a case that says new but they give you a used copy

I don't think there's any question that it's misleading, the question is does it go too far? I think if this is accurate and happening, it's over the top. If they want to bundle them all, they can at least put them side by side. Per game, not per shelf, the customer should know what they're buying, period.
I hate how gamestop trades in used games for 20% and sells for 80% it should be atleast 50% if you ask me
