The island is a landmark now because of the rare birds that have chosen to live there. The city has left it so that the birds can have the land.

@indyfan22k - I imagine the city of New York (or the state - not sure which owns it) is having enough financial difficulties right now without spending tens of millions to repair or rebuild. (Can you imagine the 'hidden' costs that would entail, including environmental restrictions? Plus, what could one use it for? A prison? They already have Riker's Island. Housing? I cannot imaginehow much it would cost to buid there - plus you then have transport costs from island to shore.
