It's actually a submissive gesture. Although some dogs actually can use it to for a smile-- they do imitate people.

I'd be scared if that dog did that around me. He looks like he is ready to attack. Funny thing is he isn't growling. I believe you that he does this when he knows he is in trouble but WOW. Make him do that to someone you don't want around and I'm sure they won't be back. lol
