Vattel's Influence on the term

a Natural Born Citizen




What is a natural born citizen? Where did the framers come up with this term? Where was it used before? So many questions, and the answers are right there if anyone wishes to search out the truth.




The term Natural born Citizen appears in our Constitution, in Article 1, Section 2, with these words, "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States."




Before the Constitution the closest reference we have to Natural Born Citizen is from the legal treatise "the Law of Nations," written by Emerich de Vattel in 1758. In book one chapter 19,




§ 212. Of the citizens and natives.




"The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country."




"Please note that the correct title of Vattel's Book I, Chapter 19, section 212, is "Of the citizens and naturals". It is not "Of citizens and natives" as it was originally translated into English.

  • Here's a scenario I am curious about. Maybe PPSIMMONS can weigh in:

    I was born in San Francisco in February of 1970. My Father is a U.S. Citizen, born in Wisconsin in the late 1930s. My Mother, at the time of my birth, was already married to my Father, and she was a Legal U.S. Resident. Her place of birth was the Central American country of Guatemala. She did eventually become a U.S. Citizen. Does this mean that I would NOT be considered a Natural-Born Citizen, for something like POTUS?

  • @prospectiveman - According to most sources - you would be eligible for POTUS if both your mom and dad were legal US citizens AT THE TIME of your birth and you were born on AMerican soil. Hope this helps.

  • @ppsimmons My child was born overseas and was an american citizen the minute she was born. She was also given a birth abroad certificate. Is she not eligible?

  • @thybigballs Sorry... must be born on US soil... her "birth abroad" certificate would disqualify her even by the most liberal standards.

  • All the talk about the birth certificate is interesting. However, that document is not the underlying question.

    The question is whether Obama is a Natural Born Citizen. That requires more than just being born in Hawaii (if he was).

    According to Senate Resolution 511 that Obama co-sponsored, the criteria includes being born to American parents. John McCain's eligibility was questioned and he passed that test.

    Obama cannot.

    His illegal taking of power is called a "coup".

  • He is above the law! Yes, we have flushed the constitution down the toilet! This is also a typical conduct for a liberal. They are always above the law. Clinton, Kennedy, etc. Someone should also investigate the death of the poor guy that looked up Obama's passport information. How convenient that he was murdered!

  • In McCain issue fell under 8 USC § 1401a which has a deferent criteria than 8 USC § 1401. 8 USC § 1401a, "of parents one of whom is a citizen of the United States who has served in the Armed Forces." while 8 USC § 1401, "a person born in the United States, and subject to the jurisdiction thereof." Anyone who is born under 8 USC § 1401 - 1409 is a NBC and eligible for POTUS.

  • @AV8R4HM Please explain why you think the people automatically granted dual citizenship by another country are not eligible to be be president. I'll get you started. 1. The automatic acquisition or retention of a foreign nationality acquired through an alien parent does not affect U.S. citizenship status. Had he applied to another country for citizenship, it might, depending on the country, but this isn't the case with Obama. Other presidents have held dual citizenship as well.

  • @AV8R4HM Short of a Supreme Court decision to change it, unfortunately for those arguing Obama is not a natural born citizen, the legal precedent for about 100 years has been *either* the fact of birth on U.S. soil or the fact of birth to parents who are U.S. citizens is independently sufficient to confer natural born status.

  • @AV8R4HM It says born or naturalized in a state. Nowhere does it say Natural Born Citizen. You cannot be naturalized and be a NBC.
