  • And then there's the extraterritoriality argument notably marshaled by Judge Kavanaugh in dissent; seems to me the greater of the the two hurdles to surmount for the petitioners (if only because Kontorovich's views are fairly novel).

  • This theory of Hamdan's relevance to ATS litigation and all that stuff about the Define and Punish Clause -- is there a forthcoming amicus brief on it in Kiobel?
