Congressman Nadler urges Congress to stand on constitutional principles and bring suspected terrorists to trial for their crimes. Rep. Nadler spoke in favor of an amendment to the Defense Authorization bill that would allow the Executive Branch to bring detainees to trial in American courts -- civilian or military -- if the President chooses to do so. This basic ability to bring a detainee to the United States to stand trial -- in any court -- is currently forbidden by law.
Rep. Nadler also cautioned against the vague language in the bill, specifically section 1034 which allows detainees to be held "until the termination of hostilities." However, in a never ending war on terrorism, the end of hostilities may never occur. Detainees should be interrogated, processed, and, if guilty, punished, not detained indefinitely .
