One of the most contentious issues that arose during the first hearing on the Impeachment Complaint against Ombudsman Merceditas Gutierrez was the issue of quorum. First, the chair recognized that there was a quorum, following the usual 1/5 of membership rule. But later, the chairman of the Committee on Justice, Cong. Matt Defensor changed the rule to the consternation of the audience and the minority and asked for a roll call, this time requiring a bigger number for the quorum. Using that new rule, the quorum was not reached and the meeting adjourned.
