You are not allowed to check for driver's license at this type of checkpoint. You have to have "reasonable suspicion" to ask for the license of the person driving. This BS will not stand.

I have deconstructed the law and found that one can lawfully travel in a private automobile on public roads without voluntary submitting for a benefit privilege. so long as he is not engaged in commerce (motor fright, taxi driver etc,,,)

If one is not earning profit or compensation, he is not required to submit application for registration (transforming automobile into a motor vehicle) which then requires one to be licensed & insured.

Why would they expose their cash cow?

I honestly dont see any violations being made. I think some people are lucky that they dont also ask for insurance and registration at these check points as well. Simply put, if you dont have a license, DONT DRIVE. And if you do, it's at your own risk.

I'm pretty sure if would be stupid for an officer to ignore if the driver smells like pot and let him go because they are checking for sobriety, not pot or anything like that.
